Eine Begrenzung der Transporte mit dem Verweis auf den Klimaschutz ist nicht grundsätzlich und in jeder Ausschreibung zulässig oder machbar. Ist dieser nicht gegeben, so liegt der Verdacht nahe, dass die Begrenzung lediglich das Ziel hat, den Bieterkreis auf örtliche Unternehmen zu beschränken. Eine wichtige Frage ist hier, welche Bedeutung die Transporte für die tatsächliche Umweltbilanz des Produktes oder der Leistung haben. So ist bei der Beschaffung von Fahrzeugen oder Elektrogeräten die Begrenzung der Transportwege des Lieferanten aus Klimaschutzgründen nicht begründbar. Es besteht daher auch kein nachvollziehbarer Zusammenhang zum Beschaffungsgegenstand. Völlig anders verhält sich dies insbesondere bei Holzprodukten.
